- Ascertain the reasons for termination and the dismissal procedure adopted by the employer. We can then advise if there is any wrongful dismissal, genuine redundancy, sham redundancy, unfair dismissal, discrimination or harassment of any sort.
- Ask you about your chances of gaining new employment.
- Calculate any damages for wrongful dismissal.
- Calculate your statutory redundancy pay.
- Consider the compensation package and whether its constituent elements [notice pay, bonuses or commission, refund of expenses, unpaid holiday pay, pension contributions, private health insurance, car, telephone, and outplacement services] are taxable or non-taxable.
- Consider the chances of improving on that package by going to the Employment Tribunal [taking into account the costs, time; stress levels and consequences to your future career].
- Draft an appropriate letter to your employer indicating inadequacies of package; determination to take matter to the Employment Tribunal or acceptance of the compensation package.
- Confirm everything to you in writing.
If you are not accepting the compensation package and wish to take the matter further, whether by way of entering into negotiations to try to “tweak” the amount of the termination package or make a claim in the Employment Tribunal, we will need to discuss the cost implication at the meeting. In the meantime, we would ask you to pay at the meeting the same amount as the employer would have paid, had you signed the compromise agreement. The amount will cover the cost of the meeting, the confirmatory letter setting out your circumstances; our advice and a letter to the employer putting him on notice that you are taking the matter further. We are able to accept payment by cash, cheque or credit card.
